Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the FOUND Africa Technology (“FOUND”, “we”, “us”), including the Digital Officers programme, the fatech.app website, and any accounts, tools, courses, competitions or communications provided by FOUND (collectively, the “Services”). By ticking the acceptance box, creating an account, or continuing to use the Services, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy.

1. Eligibility

You must be at least 16 years old (in Nigeria) and legally resident in one of our supported countries — Nigeria, Ghana, Kenya, Egypt or South Africa — to apply. Participation is open to any qualifying resident of those countries, in any state, region, county, province or governorate.

2. Your account

• You are responsible for keeping your personal email, official FOUND email, and passwords confidential. Do not share your credentials.
• Information you submit (name, phone, date of birth, LGA, bank details, uploads) must be accurate, current and belong to you.
• We may suspend or terminate your account for impersonation, fraud, duplicate submissions, abuse of the referral system, or other breach of these Terms.

3. Programme participation

• Courses, projects, competitions and stipends are offered at FOUND’s discretion and may change or be withdrawn at any time.
• Payments (stipends, prize money, seed funding) are made to bank accounts that match your verified identity. We may refuse or reverse payments to mismatched or suspicious accounts.
• Content you upload (certificates, ZIP/PDF submissions, pitches) remains yours, but you grant FOUND a non-exclusive licence to store, review, and use it for the purposes of running the programme.

4. Acceptable use

You agree not to:

• Submit false, misleading or unlawful information, or impersonate any other person.
• Upload malware, illegal content, or content that infringes another person’s rights.
• Attempt to circumvent security, rate limits, verification checks or referral rules.
• Harass, threaten, or discriminate against other members or staff.

5. Data protection

FOUND processes your personal data in accordance with the data protection law of your country. For members in Nigeria that is the Nigeria Data Protection Act, 2023 (NDPA), supervised by the Nigeria Data Protection Commission. 6. Retention and deletion

• Applications that are rejected are deleted within 7 days.
• Approved applicants who do not log in within 30 days have their data deleted and their Digital Officer serial number reassigned.
• Accounts inactive for more than 90 days may be archived or deleted after notice.

7. Intellectual property

The FOUND name, logo, curriculum, badges and site content are owned by FOUND. You may not copy, resell or misrepresent them without written permission.

8. Disclaimers

The Services are provided “as is”. We do not guarantee employment, income, prize outcomes, or specific learning results. To the maximum extent permitted by Nigerian law and by the mandatory consumer protections of Nigeria, FOUND is not liable for indirect or consequential loss arising from your use of the Services.

9. Changes to these Terms

We may update these Terms. When we do, we will bump the version shown at the top of this page and ask you to accept the new version the next time you log in. Continued use after acceptance means you agree to the new Terms.

10. Governing law & contact

FOUND Africa Technology is established in Nigeria, so these Terms are governed by the laws of the Federal Republic of Nigeria and disputes will be resolved in the courts of Delta State.
